Rais wins suit against blogger
KUALA LUMPUR: Information, Com-munications and Culture Minister Datuk Seri Dr Rais Yatim won his defamation suit against blogger Amizudin Ahmat for implying that he was guilty of raping his Indonesian maid.
High Court judge Justice Zabariah Mohd Yusof delivered her decision after hearing evidence from the blogger and submissions by both parties.
Both parties did not dispute that the words were defamatory to Dr Rais, 69, but Azimudin claimed that the article published on his blog was justified.
Justice Zabariah will hear arguments on the assessment of damages today.
Dr Rais’ lead counsel Datuk Seri Muhammad Shafee Abdullah said that his client may consider initiating contempt of court proceedings against Amizudin for violating the Feb 2 injunction order granted by the judge.
Yesterday, Amizudin testified that he had posted a banner on his blog with Dr Rais’ photograph and a link to Facebook with a caricature resembling Dr Rais.
Speaking to reporters later, Dr Rais said he was thankful.
“I have full confidence in the judiciary.
“That is why I chose the court to clear my name and image,” said Dr Rais.
Amizudin told his lawyer Pus-pawati Rosman that he had “copied and pasted” the content of the article on the Harakah Daily website dated Dec 28, 2010.
He admitted that he had published defamatory words of Dr Rais in his blog without investigating the truth of the rape allegations.
Amizudin, 42, who is also known as Din Binjai, said he went to Jakarta to investigate the matter on May 18 to look for witnesses.
He said he failed to meet the maid as she could not be contacted but met with investigator Indah Utami of Migrant Care’s – an NGO which takes care of Indonesian workers abroad – who had interviewed the maid and written a report over the matter.
Dr Rais filed a suit against Amizudin on Jan 31 saying that the blogger had published or caused to be published a defamatory article under the heading Hei Pak Menteri … mana mau lari … (Hey Mr Minister … where do you want to run to) in his blog on Dec 28 last year.
In his suit, Dr Rais claimed that the words meant that he was guilty of raping his Indonesian maid and capable of murdering her to conceal evidence over the alleged rape.
